Welcome to Icebreakers ("the App"). By using this App, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By downloading, accessing, or using Icebreakers, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old to use Icebreakers. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You agree to notify us immediately of any unauthorized use of your account

4. User Conduct

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Harass, abuse, stalk, threaten, or otherwise violate the rights of others
• Impersonate any person or entity
• Post or transmit any content that is obscene, offensive, defamatory, or inappropriate
• Attempt to gain unauthorized access to other users' accounts or our systems
• Use the App to send spam, chain letters, or other unsolicited communications
• Upload viruses, malware, or any other harmful code
• Interfere with or disrupt the App or servers connected to the App

5. Content

Your Content

• You retain ownership of content you post through the App
• By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the App
• You are solely responsible for your content and the consequences of posting it

Our Right to Remove Content

We reserve the right to remove any content that violates these Terms or that we find objectionable, without prior notice.

6. Matching and Interactions

• Icebreakers facilitates connections between users but does not guarantee any particular outcome
• We are not responsible for the conduct of any user, whether online or offline
• You interact with other users at your own risk
• We encourage you to exercise caution and use good judgment in all interactions

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• The App will meet your requirements
• Any defects will be corrected
• The App is free of viruses or harmful components

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Personal injury or property damage
• Any conduct or content of any third party on the App

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity

12. Termination

• You may delete your account at any time through the App settings
• We may suspend or terminate your account at any time for any reason, including violation of these Terms
• Upon termination, your right to use the App ceases immediately

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or by other means. Your continued use of the App after changes constitutes acceptance of the new Terms.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits.

15. General Provisions

• These Terms constitute the entire agreement between you and us
• Our failure to enforce any right does not waive that right
• If any provision is found unenforceable, the remaining provisions remain in effect
• These Terms are governed by the laws of the State of California
